• In this document, “you,” “your,” or “user” refers to any individual or legal entity browsing, using, subscribing to, or accessing Akidha.

By browsing our portal, you automatically agree to adhere to our “terms and conditions” drafted for Akidha. By using Akidha, you automatically agree to have read, understood and accepted all the terms and conditions listed.

All content, materials, trademarks and tools available on this portal are exclusively owned by Ohlogy and are protected by applicable copyright, trademark and intellectual property laws. Users are permitted to view, download, or print content strictly for personal, non-commercial use restricted to purchasing or learning about our products and services.

Unauthorized access to Akidha’s content, for instance, copying, modifying, distributing, transmitting, or creating derivatives without prior written consent, is strictly prohibited. Any misuse may result in legal action and liability for damages payable by the user.

Substitute Options:

The user shall upload a valid prescription to place an order. Affordable substitute medicines shall be recommended to the users over the call before the final checkout. Only the medicines you confirmed from the affordable substitute shall be added to the cart for checkout. Please be assured that all the affordable substitutes suggested are of the same salt composition and strength.

Please make a note that we only provide affordable substitutes that are formulated in an ISO-certified facility and are known top brands. All the communications are recorded further for regulatory purposes without user approval.

Jurisdictional Compliance:

Our e-pharmacy portal complies with Indian laws. If you are accessing Akidha from outside India, do so at your own risk. We shall not be liable for any compliance with any applicable local laws outside India.

Other Information:

Akidha enables online sale of both conventional and alternative pharmaceutical products, except those listed under Schedule X of the Drugs & Cosmetics Act, 1940 and its Applicable Rules and Regulations (referred to as the “Products”).

1. The online selling of medicines from reputable brands. Akidha holds all licensing and distributing authorities to sell medicines to you (“You,” “Your,” or the “User”) in accordance with the listed Terms of Use;
2. Recommending affordable substitutes for medicines;
3. The delivery of products ordered by you shall be fulfilled through independent third-party logistics providers (“Third Party Delivery Partners”).

Ohlogy has obtained all necessary Licenses and Regulatory approvals as required under the Drugs and Cosmetics Act, 1940 and the Food Safety and Standards Act, 2006, to lawfully operate and offer its services through this platform.

Privacy

Your privacy and that of any other person whose information you provide to us are important to us. Please read our Privacy Policy carefully for details of what information we collect and how we will use and protect it.

Registration

By registering and continuing to use the portal, you agree to confirm your age as eighteen years (18 years) or above. Hence, you are not legally debarred from reading and accepting the terms and conditions provided herein. The users are required to Register or Sign in to successfully place an order. Akidha is not obliged to accept any request for Sign-up or Login. Hence, the portal does not reserve, suspend, or terminate access to any of its users.

Username and password:

While registering on the portal, you may be asked to enter the chosen username and password that shall be unique for every user, or it could also include a One-Time Password (“OTP”), which shall be sent to your mobile phone number via SMS. The details, such as OTP, Username and Password are meant to be confidential, ensuring they are not used or misused by anyone. As part of the process of registration, we may ask for:

• Gender
• Age
• Phone Number
• Mode of Payment

Order Confirmation:

Any order placed on Akidha that is unconfirmed from your end shall not be processed. We hold all the rights to reject any order at any point of time after successful order placement.

Verification of Prescription:

1. Akidha holds all the right to decline and take legal action against the order if the user has uploaded an invalid, tampered, or fake prescription to avail medicines.
2. Please make a note that we only process orders of those who have uploaded a valid prescription by the Certified Medical Practitioner.
3. If any prescription contains unusual quantities of medicines or Schedule X Drugs, Akidha reserves its right to reject the order.
4. Upon uploading any prescription on the portal, our experts can get in touch to verify certain details regarding your order.
5. Any manufacturing fault/lapse/error in the medicine delivered to you doesn’t hold Akidha or Ohlogy liable for the damage, loss, or compensation in any way.
6. Akidha shall not be held responsible for any medical negligence or wrong prescription upload done by the users.
